Nestlé has won a ten-year-long court saga preventing Mondel?z from trademarking the colour Pantone 2685C, or "Dairy Milk purple".
The UK's Supreme Court this morning refused to allow Mondel?z International's appeal against a decision made in October of last year which prevented the group from trademarking the specific shade of purple.
Mondel?z has been trying since 2004 to trademark the colour thus preventing a whole range of products from using it.
In a statement released this morning, Nestlé's corporate Communications department said that: "We welcome the Court of Appeal's decision to uphold Nestlé's objection against Mondolez's proposal to trade mark its Dairy Milk "Purple" colour across a broad range of products."
"We believe this is the right outcome from a legal perspective," the company said.
With no more avenues for appeal open to Cadbury, a spokesperson said that : "We are disappointed by the latest decision but it's important to point out that it does not affect our long held right to protect our distinctive colour purple from others seeking to pass off their products as Cadbury's chocolate."
